Claycoded Terms & Conditions

Effective Date: 22/05/2025

These Terms and Conditions apply to all work carried out by ClayCoded (“we”, “us”, “our”) for our clients (“you”, “your”). By paying your initial 50% deposit, you agree to the following terms.

 

1. Services We Provide

We offer the following services:

  • Website design and development
  • Website rebuilds
  • Website hosting
  • SEO support
  • Website copywriting

 

All work is quoted in advance and customised to your specific project needs.

 

2. Project Payments

We require a 50% deposit before any project begins. This is non-negotiable, regardless of deadlines or priority.

The remaining 50% balance is due within 7 days of the website going live. We will not provide full admin access or make a site live until this final payment is received.

Payments can be made via card or bank transfer only. We do not accept cash or cheques.

 

3. Refunds & Cancellations

We do not offer refunds for unused time. We work efficiently and fairly — if your project takes fewer hours than estimated, we do not reduce the price.

If a project is cancelled before we begin work, the 50% deposit will be refunded in full and the final balance cancelled.

If the project is cancelled after we’ve started design or development, we reserve the right to retain the 50% deposit. If significant progress has been made, we may invoice for additional work up to the full quoted price.

 

4. Timelines & Revisions

We’ll provide an estimated completion date based on the project scope. Timelines are flexible as feedback delays or missing content can affect progress.

Each page includes 2 rounds of revisions (covering both text and design). Additional rounds or major scope changes will be quoted separately.

 

5. Ownership & Access

You own your website once full payment is made. Until then, the design, development and admin access remain with us.

We may request to place a small credit to ClayCoded in the site footer, but this is optional. However, we reserve the right to include completed projects in our portfolio unless a white-label agreement is signed before the project begins.

 

6. Hosting & Maintenance

Hosting is optional. If you use our hosting, we include an Elementor Pro licence key and security monitoring.

If you choose not to host with us, you’ll need to set up your own hosting and purchase your own Elementor Pro licence before we hand over the site. This prevents compatibility issues and handover errors.

If hosting payments are missed for 2 consecutive months, we reserve the right to disable the live site and display a temporary “maintenance” page until payments are resolved or hosting is moved elsewhere.

 

7. Support & Warranty

We offer 30 days of post-launch support to fix any bugs or technical issues that arise after the website goes live.

If a client breaks something or introduces errors after handover, we may charge to repair it.

Ongoing support is available through our hosting plan or by separate agreement.

 

8. Client Responsibilities

You are responsible for supplying your content, imagery and logos unless we agree otherwise.

We can assist with copywriting or provide stock imagery as needed for an agreed fee.

If you delay the project by not providing required content, we may pause the project until you’re ready. If placeholder imagery is acceptable, we can continue building.

Paused projects must resume within 3 months or we reserve the right to cancel them.

 

9. Licensing & Tools

We may use third-party tools or plugins, both free and paid. Where paid plugins are required and not included in our hosting plan, the cost and licensing responsibility lies with you.

 

10. SEO & Performance

We do not guarantee SEO results or lead generation. SEO takes time, and results depend on many external factors.

If you provide your own content, we cannot ensure it will be optimised for SEO.

We accept no responsibility for site speed or performance issues post-launch unless agreed upon during the build. We do our best to launch well-performing sites, but cannot be held accountable for all future factors.

 

11. Acceptable Use

We do not work on websites that promote illegal, offensive or harmful content. We also avoid projects relating to gambling unless agreed in writing.

 

12. Scope Changes & Extra Work

If additional work is requested outside the original agreement (e.g. new pages, feature changes), we will assess the task and issue a separate quote. This must be paid before the new work begins.

 

13. Client Conduct

We reserve the right to cancel any project if a client is unreasonably difficult, unresponsive, or is actively preventing project progress. In such cases, the original deposit is non-refundable and additional charges may apply if more than half the project has been completed.

 

14. Data & Communication

We store all email and project communication for reference. This helps protect both parties, track project scope, and support future work.

We will never sell or share your information with third parties.

 

15. Governing Law

These terms are governed by UK law, and any disputes will be handled through the courts of England and Wales.

 

16. Agreement to These Terms

By paying your deposit or using our services, you agree to the terms outlined on this page.

 

17. Updates to These Terms

We may update these terms at any time. The current version will always be available on our website and will apply automatically to all future work.

When updated, we will include a summary of changes and a new effective date so clients are kept informed.
